Introduction
Welcome to the website of the “Leading the Pack” Foundation – the home of alumni of the Oketz Unit (the “Website”).
Our full name is Leading the Pack – Oketz Unit Alumni Association (R.A.), a registered non-profit association, registration number 580447415 (the “Association” or “we”), located at 1 University Street, Herzliya 4634865. The Website operates at www.oketzfoundation.org and at any other address the Association may determine.
Using the Website, including its content and services, constitutes your agreement to these terms, to the Website’s Privacy Policy, and to additional provisions and rules we may present to you (“you” or the “User”) during your use of the Website (together: the “Binding Documents”).
The Binding Documents are written in the masculine form for convenience only, and apply equally to all genders. Any reference in singular also applies to plural, as relevant.
Please read the Binding Documents carefully, as they constitute a binding agreement between you and the Association and define your rights and obligations when using the Website. The Binding Documents may change according to the Association’s needs, and therefore we recommend checking them from time to time. If you do not agree to the terms – you are requested to refrain from using the Website.
The Binding Documents apply to the use of the Website from any computer or other device (such as smartphones, smartwatches, tablets, etc.).
The Website includes a designated area or references where Association documents can be reviewed (including various protocols and the Association’s bylaws). For the avoidance of doubt, nothing in the Binding Documents detracts from the binding validity of the Association’s bylaws or the Associations Law, 1980, regarding membership in the Association and its activities.
About the Association and the Website – in brief
The Association was established in 2005 by unit alumni and parents of soldiers serving in the unit, past and present. It operates as a non-profit organization, through an elected board and members serving voluntarily and with dedication.
The Association’s vision is to stand by all soldiers, from their arrival to the unit and after their release. The Association is committed to supporting soldiers and alumni of the Oketz Unit, out of love for the country, people, and unit. We act to the best of our ability and without bias, for the welfare of Association members, in professional and value-based fields alike.
The Website provides extensive information and content about the Association, including its various programs, staff (such as the executive board, audit committee, advisors, etc.), information about the unit, memorial pages, activity areas, news and updates, events, and more. These are intended for the general public, Association members, and friends of the Association.
Use of the Website is free of charge and serves as an online gateway to information about the Association, its activities, and ways to join. The Association has sole discretion to decide what services, content, and information will be displayed on the Website, for how long, in what format and design, and any other matter related to them.
The professional information and content on the Website do not constitute an opinion, recommendation, or offer, and should not be considered as advice tailored to any individual’s specific circumstances. To avoid doubt, the Website’s content is for general information and guidance only. In case of doubt regarding the need for professional advice, you must consult the relevant professionals.
Although the Association makes efforts to ensure that the information and data on the Website are correct, reliable, and up to date, it does not guarantee their accuracy, completeness, or timeliness, nor their suitability for any particular purpose.
Online Forms and Services on the Website
The Website is open to the general public and does not require registration or submission of personal details to browse its content.
The Website includes two registration options – membership registration for unit alumni, and registration as a “Friend of the Association.” Sections of the Website that require registration or submission of details are intended only for users aged 18 and above, or other legally recognized entities, and according to law. Membership and activities in the Association are subject to its bylaws and the Associations Law.
If you are asked to provide details, including personal information, in order to use certain Website services, you must provide accurate and complete information. Incorrect details may prevent you from fully using the Website or, if necessary, hinder contact with you.
The Association will use your information, including personal information you provide, in accordance with the Website’s Privacy Policy, which forms an integral part of these Terms of Use.
The Website also allows you to donate to the Association – donations are not processed directly on the Website or with the Association, but the Website will redirect you to the donation platform where the Association manages its fundraising. Use of that platform is subject to its terms, not these Terms of Use.
Sending Information, Including Marketing Information
Where you give your consent on the Website, we may send you updates about the Association’s activities, advertisements, and other messages, in accordance with Section 30A of the Communications Law (Telecommunications and Broadcasting), 1982, and the Privacy Protection Law, 1981. These messages will be sent to your contact details, via any existing or future means of communication. For clarity, such messages may include newsletters, surveys, social media contact, and similar or future technologies. You may withdraw your consent at any time by sending a refusal notice, as explained in each message.
Intellectual Property
All intellectual property rights, especially copyrights, in the Website, its services, and all its content (including design, charts, photographs, code, images, texts, multimedia, etc.) belong exclusively to the Association or to third parties who authorized its use. No part may be copied, distributed, publicly performed, broadcast, made available, adapted, sold, or rented without prior written consent from the Association or relevant rights holders.
The Association’s trademarks, registered or not, are its sole property and may not be used without prior written consent. Trademarks and advertisements of third parties appearing on the Website (such as business partners and sponsors) belong to them and may not be used without their express permission.
Use of the Website
You confirm that you have the full right and authority to use the Website and to be bound by the Binding Documents. You agree to comply with all their provisions and all applicable laws. Use of the Website in any manner not permitted by the Binding Documents requires the Association’s prior written consent. In particular –
- Do not use the Website in any way that constitutes or may constitute a criminal offense, civil wrong, or violation of third-party rights (including privacy or intellectual property rights).
- Do not copy or use content from the Website in other sites, apps, electronic or printed publications, etc.
- Do not attempt to bypass, disable, or interfere with the Website’s security mechanisms.
- Do not run programs or tools (such as crawlers, robots, etc.) to search, scan, copy, or automatically collect Website content, nor use such tools to create collections or databases.
- Do not display Website content in any way that alters their design or omits parts.
- Do not link to the Website from sources with pornographic, illegal, racist, or discriminatory content, or content encouraging unlawful activity.
- Do not mislead, deceive, or provide false information when using the Website. Act in good faith towards the Association and other users.
- Do not transmit or publish unlawful, obscene, harassing, offensive, hostile, threatening, racist, defamatory, or otherwise inappropriate content.
The Association may monitor Website activity for security purposes and to detect fraud or misuse.
Liability
Wherever the Binding Documents specify liability (or lack thereof) of the Association, it applies also to its employees, directors, and representatives.
The content and services are provided as is. They cannot be tailored to each individual. You will have no claim against the Association regarding the Website’s features, suitability, or limitations. Use of the Website is entirely at your own risk.
Although the Association makes efforts to ensure quality, reliability, accuracy, and currency of the Website’s content, errors may occur. The Association will not be liable for any disruption, inaccuracy, or error in content or services, nor for any direct, indirect, incidental, or consequential damage resulting from use of or inability to use the Website.
The Association does not guarantee uninterrupted, error-free, or secure Website operation, nor immunity from unauthorized access or technical issues.
Breach and Indemnification
Without limiting other legal provisions, you undertake to indemnify the Association, its employees, directors, or representatives for any breach of these Terms or the Binding Documents, or unlawful activity related to the Website. This indemnification covers any expense, loss, or damage (direct or indirect), including legal fees.
Links
The Website may contain links to external sites and content not controlled by the Association. The Association is not responsible for their legality, completeness, reliability, or suitability, nor for damages arising from their use. Links may not always function, and the Association may add or remove them at its discretion.
Social Media Channels
The Website also links to the Association’s social media pages (Facebook, Instagram, etc.). These are operated by independent international companies and are subject to their own terms and privacy policies. Use of them is at your own risk.
Careers
The Website may include job postings. These usually contain descriptions, requirements, and application instructions. Postings change according to the Association’s needs and do not constitute a commitment to hire.
Changes and Suspension
The Association may remove, update, or modify Website content, or suspend the Website for maintenance. It may also change the Website’s structure, design, and scope of services at any time, without prior notice.
Such changes may cause inconvenience or malfunctions. You will have no claim regarding these changes.
In case of conflict between Website information and the Association’s official records, the official records prevail.
Governing Law and Jurisdiction
Israeli law governs these Terms, regardless of your location. The exclusive jurisdiction for any dispute lies with the competent courts in the Tel Aviv–Jaffa District, Israel.
Amendments to the Binding Documents
The Association may amend these Terms from time to time. Material changes will be announced on the Website’s homepage or via your provided contact details. If required by law, changes will take effect accordingly.
Continued use of the Website after changes constitutes your acceptance. If you disagree, you must stop using the Website. Updated versions will always be accessible through the Website.
Privacy
We respect your privacy when using the Website. The Privacy Policy is part of the Binding Documents. Since it may change, please review it periodically.
Assignment
You may not assign or transfer rights or obligations under these Terms without prior written approval from the Association. Any attempt otherwise is void. The Association may transfer its rights and obligations at its discretion, provided the transferee assumes the Association’s obligations.
Miscellaneous
Failure of the Association to enforce any provision does not waive its rights. If a court finds any provision unenforceable, it will be enforced to the extent possible, and the rest remain valid.
